Dividing Complicated Retirement Accounts

Retirement accounts are notoriously hard to divide, especially if retirement benefits are accumulated during the marriage. These assets are addressed through a qualified domestic relations order (QDRO).

According to federal law, a retirement account can only pay out benefits to its account holder. A QDRO consists of a court order or decree that allows an ex-spouse to receive benefits from a retirement account that is not their own.

The court itself does not prepare the QDRO, however, but rather approves it. Preparing these documents requires close understanding of the interaction between state and federal retirement benefit laws.
